Dan Chirlin is a veteran lawyer who regularly represents individuals and organizations in civil, criminal, and regulatory matters. He counsels clients in connection with complex business disputes over a wide range of matters, including breach of contract and business torts, securities actions, and employment disputes. He also has experience representing individuals and companies in internal investigations and in enforcement matters before the U.S. Department of Justice, district attorneys’ offices, state attorneys general offices, the Securities and Exchange Commission, the Commodity Futures Trading Commission, FINRA, and other self-regulatory organizations and state agencies.
Dan also regularly advises and represents a professional NBA franchise on matters relating to ticketing, investigations, contract disputes, and regulatory matters.
Dan takes a hands-on approach with every matter, becoming deeply familiar with the facts and the needs of his clients. He believes that the practice of law is about—first and foremost—client service. Dan is known for his tenacious excavation of facts and his penchant for finding creative solutions to seemingly intractable problems. He practices law by the axiom that you never bring a problem to a client without likewise offering several possible solutions.
Dan often collaborates with his adversaries to reach equitable resolutions for his clients, but he is an equally aggressive litigator when required.
Dan has extensive experience in financial crimes compliance, serving on the executive team of a two-year monitorship of an international bank.
Dan also regularly contributes to several publications, including the Practicing Law Institute and Law360. He is the author of chapters in treatises on bank monitorships and CFTC enforcement.

Financial Institutions. Served as regulatory enforcement counsel for an international financial institution. Handled matters before the CFTC, FINRA, NFA, and a number of options and futures exchanges. Handled a variety of matters related to futures and derivatives trading, including wash trades, spoofing, position limits, EFRPs, block trades, cross-trading, and front-running.
Internal Investigations. Conducted sensitive internal investigations for public and private companies, non-profit organizations, and government agencies in a wide variety of matters including, auto-parts, futures and commodities, pharmaceuticals, health care, public safety and OFAC sanctions.
Investment Advisers. Represented investment advisers in SEC examinations and SEC and FINRA enforcement actions.
Bank Monitorship. Served on the executive team of a two-year bank monitorship related to financial crimes compliance (AML and OFAC).
Whistleblower. Represented individuals in filing whistleblower complaints with the SEC, DOJ and New York Attorney General.

NBA. Represents NBA team in connection with a wide variety of advisory and litigation matters, including ticketing, brokers, trade secrets, investigations, commercial and tort lawsuits, and regulatory matters.

Complex Commercial
N.Y. Knicks v. Toronto Raptors, et al. Represent plaintiff in a theft of trade secrets dispute between two NBA franchises.
Private equity arbitrations. Represented multiple private equity clients and investors in a variety of disputes, including partnership disputes, harassment complaints, contract disputes, and forced sales.
In re Clarus Therapeutics. Defended three directors in connection with an adversary proceeding arising out of a reverse-SPAC transaction.
In re Tether and Bitfinex Crytpo Asset Litigation. Represented defendants in billion dollar class action lawsuit involving allegations of market manipulation, antitrust, RICO and fraud.
In re Oxbow Carbon LLC Unit Holder Litigation. Represented majority shareholder of an energy company in contentious bet-the-company litigation over minority investor’s attempt to force a sale. Won the case on an appeal to the Delaware Supreme Court.
